
Clam Messenger Terms of Use

These Terms of Use (“Terms”) apply to your use of Clam Messenger (“Clam”, “Clam Messenger”, “the App”, “we”, “us”, or “our”), operated by Serhii Bakhmat.
By using Clam, you agree to these Terms. If you do not agree, please do not use the App.
1. What Clam is
Clam is a messaging app designed for private communication between users. The App may include features such as one-to-one chats, group chats, file and media attachments, saved notes, contact management, blocking, reporting, and other related messaging features.
Clam is currently free to use. We may add optional paid features in the future. If we do, we will explain the price and terms before you purchase or subscribe.
2. Your account and recovery phrase
You are responsible for keeping access to your account, device, recovery phrase, and app data safe.
If Clam gives you a recovery phrase, you must store it securely. We may not be able to restore your account, messages, keys, contacts, or local data if you lose your recovery phrase, delete local data, lose access to your device, or remove required keys from your device.
You agree not to access or try to access another person’s account without permission.
3. Your content
You are responsible for the messages, files, photos, videos, names, group titles, and other content you create, send, receive, store, or share through Clam.
You confirm that you have the rights or permission needed to share any content you send through the App.
We do not claim ownership of your content. You keep your rights to your content.
4. Acceptable use
You agree not to use Clam to:

harass, threaten, abuse, impersonate, or bully others;

send illegal, harmful, hateful, violent, sexually exploitative, or abusive content;

share content that violates another person’s privacy or intellectual property rights;

send spam, scams, fraud, phishing attempts, malware, or deceptive content;

attempt to break, overload, reverse engineer, disrupt, or abuse the App, servers, security systems, or other users’ devices;

use the App for illegal activity or to encourage illegal activity;

use the App in a way that violates applicable laws or these Terms.
5. Blocking, reporting, and moderation
Clam may provide tools to block users, block accounts, block devices, report contacts, or report abuse.
Because Clam is designed for private communication and may use end-to-end encryption, we may not be able to see the content of your messages unless you provide it to us as part of a report. When you report abuse, please include enough information for us to review the issue, such as the account ID, screenshots, description of the issue, or other relevant details.
We may review reports and take action when we believe it is necessary, including limiting features, removing access, blocking accounts or devices, or contacting appropriate authorities where required by law.

6. Privacy and security

You are responsible for using strong device security, keeping your recovery phrase safe, updating your software, and protecting access to your device.
7. App availability and changes
We may update, change, suspend, or discontinue parts of Clam at any time. Some features may not always work, may depend on your device, operating system, network connection, server availability, or the version of the App you use.
We work to keep Clam reliable and secure, but we cannot guarantee that the App will always be available, uninterrupted, error-free, or completely protected against every possible security risk.
Clam is not intended for emergency communications. Do not rely on Clam to contact emergency services or for situations where failure or delay could cause harm.
8. Third-party services
Clam may rely on third-party services, platforms, operating systems, app stores, hosting providers, or backend providers to operate. Their own terms and policies may also apply.
We are not responsible for third-party services that we do not control.
9. Intellectual property
Clam, including its name, design, logo, software, interface, and related materials, belongs to us or our licensors.
You may use Clam only as allowed by these Terms and the app store rules that apply to your download or installation.
You may not copy, modify, distribute, sell, rent, sublicense, or create derivative works from Clam unless we give you written permission or applicable law allows it.
10. Termination
You may stop using Clam at any time.
We may suspend or terminate your access to Clam if we believe you violated these Terms, abused the App, created risk for other users, or used the App illegally.
Some data may remain on your device, other users’ devices, backups, or systems outside our control after you stop using the App.
11. Disclaimers
Clam is provided “as is” and “as available”. To the maximum extent allowed by law, we make no warranties that Clam will meet your expectations, be uninterrupted, be error-free, or be protected against every possible security risk.
12. Limitation of liability
To the maximum extent allowed by law, we will not be liable for any claim, loss, damage, or cost arising from your use of Clam. If applicable law does not allow liability to be fully excluded, our total liability will be limited to the lowest amount permitted by law.
13. Changes to these Terms
We may update these Terms from time to time. If we make important changes, we may notify you through the App, website, App Store listing, or another reasonable method.
Your continued use of Clam after the Terms are updated means you accept the updated Terms.
